My Philosophy

At Charles N. Castagna Mediation, Inc., my goal is to assist lawyers and their corporate and/or individual clients, as well as unrepresented parties (otherwise known as Pro Se), resolve their disputes in an informal, confidential and non-adversarial setting. This is most effectively accomplished when the parties are given every opportunity to consider and evaluate every aspect of their dispute, and to discuss through the mediator how they feel their dispute should be resolved. This is the purpose of mediation, and it is my purpose in serving as a mediator.

My mediation style can be described as proactive, patient and creative. I believe it is very important to be involved in the process, but with the upmost respect for the participants’ absolute right to fully and freely exercise self-determination in attempting to reach agreement.

It is of paramount importance that the mediator’s responsibilities are performed in a neutral and impartial fashion. This is a hallmark of my mediation practice. I encourage participants to let me know immediately if they feel I am not acting in a neutral and impartial fashion, or if they have any concerns whatsoever as to how the process is being conducted. One of the hallmarks of mediation is the parties’ right to decide the outcome of their dispute with the assistance of a neutral and impartial third party who is actively involved in helping them evaluate options and consider the strengths and weaknesses of their case.

I have been serving as a mediator since 1988 and have seen some remarkable results over the years. Not every case or dispute gets resolved, but many do, and it is an honor and a privilege to participate as a catalyst in that process. Even when cases or disputes do not get resolved at mediation, more often than not, participants leave the process learning something of value and feeling that their participation in the process was worthwhile. And more often than not, even if the matter is not resolved at the mediation, it is resolved as a result of their efforts in mediation and without having to go to trial.

Areas of Practice

Respected Florida Mediator Provides Alternative Dispute Resolution Services

Clearwater firm delivers trusted service to clients

Through mediation, Charles N. Castagna Mediation, Inc. in Clearwater can help you resolve disputes appropriately while limiting expenses and maintaining a professional atmosphere. Mr. Castagna is a Federal Mediator and a Florida Supreme Court Certified Circuit and Family Mediator with over 30 years of experience handling mediations throughout Florida.

Any time there are two or more parties with vested interests in a legal or business matter, disputes can occur. He uses his decades of experience to help business and individual clients resolve their legal issues through this means of alternative dispute resolution.

Mediator offers client-focused dispute resolution services that cover a variety of issues

Mediation is about helping two parties find common ground, and that is what he does best.  Since 1988, he has successfully mediated thousands of cases involving a variety of disputes. Some of the types of disputes he commonly mediates cover the following areas:

  • Personal injury
  • Divorce and family law
  • Insurance disputes
  • Real estate
  • Condominium/HOA matters
  • Construction
  • Business and contracts
  • Landlord-tenant
  • Labor and employment
  • Workers’ compensation
  • Probate
  • Securities

His role as an effective and ethical mediator is to help guide the parties and their counsel to a mutually agreeable conclusion.  As an impartial third party, he assists each side in considering the strengths and weaknesses of their case and find ways to help them consider other points of view throughout the process.

Helping parties preserve relationships and avoid costly litigation through mediation

Litigating disputes through the court system can take a significant emotional and financial toll on both parties in the conflict. Mediation is increasingly used as a means of alternative dispute resolution to avoid the delay, expense and stress typically involved in litigation. The parties in a dispute often have long-standing relationships, such as business partners or even family members, and mediation allows both parties to voice their concerns and feel they are being heard in a setting that is cooperative rather than adversarial.

Mediation is not compulsory in most situations, and what is discussed during your session is confidential except as required or permitted under Florida law. Not every dispute or case gets resolved during mediation, but many do, and I consider it a privilege and an honor to participate in the process. Even when cases aren’t resolved through mediation, the steps taken during the mediation process often serve as a valuable catalyst for a later agreement that helps the parties avoid costly litigation.

  • Once again, this course was excellent!  It is always a pleasure to attend a course that actually provides useful information for my practice!  5 stars all the way!

  • Charles's mediation certification training was excellent.  The entire course was incredibly well organized, interesting and thorough.  Charles's depth of experience as a mediator ensured that each topic was covered in a pragmatic and interesting manner.  The guest faculty was similarly helpful and informative.  I enthusiastically recommend Charles as a mediation certification trainer.

  • Charles did a great job presenting, organizing, and coming up with materials for this class. The class I participated in was his first Zoom class. I strongly believe nothing was lost by taking the certification class by Zoom. I strongly recommend his course to people considering adding another skillset. Thank you Charles!

  • Dear Charles, Having just completed your Circuit Civil Mediation training course, I want to thank you for the great program you put on. It was informative and offered a perfect mix of practical instruction and reading material. In addition to preparing me to be a mediator, the course no doubt will make me a better prepared litigator at mediations. Well done!

    - Nicholas Ottaviano, Esq.
  • I have never looked so forward to a legal education class.  I feel blessed to have been a part of this particular group, the historic, first Zoom class for our fearless leader.  Thank you Charles for assembling such a wonderful group of people and for keeping it fast and furious. The guest speakers were also outstanding. I learned so much from my classmates at the same time that we were having a blast. Let's stay in touch.

  • Thank you for today’s excellent program and presentation, and for the prep you provided ahead as well.

As one who has been Certified as a Circuit Civil Mediator but who is treading water still as to when I begin adding that role to my practice---  your updates and teachings are the perfect tool for the 2 year credits, AND for the useful knowledge which I can apply in mediating cases with my clients.   I wish every litigator had to have the training of a mediator, as they would likely be better litigators!
